Online Booking Terms and Conditions
The Online Booking Terms below are applicable as of January 1st 2021.

We ask you to read our Online Booking Terms and Conditions as you will be asked to confirm that you have read and understood these before your booking can be confirmed. If this is your first rental experience with GETABOAT.MIAMI we recommend that you read our ‘How to book Guide´ and associated links for more detailed information. If you intend to rent in a new country of destination please look at the Specific Licencing and Sailing Terms for that country. Following these guidelines will help you to: - understand what you can expect from us; -get the key information that will help you to organize your rental and trip; -understand what we need from you in order to complete your booking successfully. GETABOAT.MIAMI mostly arranges bookings on behalf of and for the account of the charter company, the yacht's owner or local charter operator.

I. Online Booking Process
The following are the main steps to making an online booking:

(i) First Step: Selection of the service – Enter the destination and boat type required. Select the boat of choice and check availability.

(ii) Second Step: Based on the criteria you provide, GETABOAT.MIAMI will provide you with an offer matching your needs in the form of a detailed recapitulation. The ‘offer' is legally defined as: - a service which includes a selected boat category available for a chosen duration with selected options (if any) - a rate which is always prepaid.

(iii) Third Step: Acceptance of the offer: Enter all details and confirm that all contact, boat and date details are correct prior to confirmation.

(iv) Fourth Step : Confirmation: You will then be asked to confirm this acceptance*.
*It is the users responsibility to confirm all boat details and extras pricing PRIOR to booking the boat. GETABOAT.MIAMI will not refund or cancel bookings based on customer 'preference' or the boat not being equipped for what they need.

(v) Fifth Step : GETABOAT.MIAMI notification; GETABOAT.MIAMI will send you confirmation of the booking (if applicable) including the booking number (booking confirmation ID). The confirmation notice will include the details of your reservation.

II. Confirmation of Booking by
At the end of the booking process you will be taken to the "Booking Confirmation" page; the booking number will be clearly visible. You will also receive a confirmation email containing the details of your reservation. Please print these and keep them for your records.

III. Reservation Details
Booking Date: - we can accept bookings for between 4 days and 12+ months’ notice - We cannot guarantee bookings for same / next day

Minimum Rental Duration: - The minimum rental period is standard 1 day depending on the location. Vehicle collection and return is included within this 24 hour period.

Maximum Rental Duration: We can accept bookings for long periods of time – please contact GETABOAT.MIAMI directly to arrange. 

IV. Rates
Your GETABOAT.MIAMI charter quote takes into account BOAT PRICES ONLY. This quote generally includes the following items: the price of the boat (including discounts and special offers). An excess amount displayed at time of booking confirmation indicates the maximum amount of money you are liable for in the event of damage to the boat. This excess amount may be waived in some countries by purchasing optional additional protection at time of booking or arrival.

The list of these charges will be present on the booking confirmation or verified over the phone by an operator.

The rates are guaranteed for the rental associated to the confirmed booking.

Additional charges to your basic rental rate may include: - Obligatory extras: Local partners may apply mandatory additional charges such as final cleaning and transit log fees to the final boat price. Other options: Skipper, Fuel, Cooks, Hostesses may all incur further charges on top of booked price. Additional equipment: for further information on additional equipment, you need to contact GETABOAT.MIAMI directly to confirm pricing. 

V. Payment / Means of Payment / Deposit Terms and Conditions
A. Payment
"Book now" - Online booking:

When opting to book online, payment of the full estimated amount will occur as follows:

If charter date is within 3 days – 8 weeks: Full payment of booking is required within 48 hours.
If charter date is 9 weeks or more – 50 % of full payment is required within 48 hours of booking and final payment is required 8 weeks prior to the due date.
Failure to pay once opting to book online can result in legal proceedings and prosecution.

B. Means of Payment
Payment can be made using the following means of payment:

Bank Transfer: GETABOAT.MIAMI Bank account details are provided on the booking confirmation and accept payment in form of bank transfer. If payment is made by bank transfer, it is the responsibility of the renter to ensure that the correct amount is transferred (in reference to exchange rates for USD $ prices). The renter also accepts responsibility for payment receipts being forwarded to GETABOAT.MIAMI and ensuring that payment has been received by GETABOAT.MIAMI.
Credit card(s): Credit cards usually accepted within YACHTICO.com are "MasterCard" and "Visa".
Additional surcharges apply for clients wishing to pay with "American Express".
Payment using credit(s) card(s) is (are) accepted in accordance with the limits authorized by your credit card issuer;
The credit card holder must be identified as the renter (the "main renter" to be mentioned on the booking agreement) OR needs to have written consent in the form of a third party authorization form for use of another’s credit card. Failure to do so can result in legal proceedings and prosecution.
PayPal: Valid PayPal account holders can choose to pay the confirmed amount via Pay pal and are provided with the details and opportunity to so on the booking confirmation.

C. Deposit - Transaction Authorization
During the rental

At time of "Check-out":
All transactions beyond the final payment are completed directly with the local partner – i.e. additional extras to be paid at base. GETABOAT.MIAMI bares no responsibility for any errors committed by the local partner in regards to pricing of extras, transaction errors and deposit returns.
Warning: Amount of deposit depends on the policy of the ‘Local partner’ and may vary from one boat, partner or country to another (it is strongly recommended that customers consult GETABOAT.MIAMI directly for any questions prior to booking)

At time of "Check-in":
If the boat is returned without fuel, in an untoward condition or in a particularly unclean state, the local partner is at liberty to charge additional costs for the re-fueling, repair or additional cleaning efforts. GETABOAT.MIAMI accepts no responsibility for any additional costs incurred as a result.

VI. Qualification at Time of Booking & Rental: Documentation

VII. Changes to Reservation: Modification/Cancellation Policy - No fees apply within 24 hours!
You can modify or cancel your reservation online after it is confirmed, provided it is done within 24 hours of the original booking confirmation. To modify or cancel a booking, you need to contact GETABOAT.MIAMI customer service directly by phone.  

Please note that in order to modify or cancel the booking confirmation you must have the booking confirmation ID, name and details of the renter on the booking agreement.

Cancellation Before Embarkation:

More than 6 month before embarkation: 30% cancellation fee will be charged (min. USD150)
From 6 month to 8 weeks before embarkation: 50% cancellation fee will be charged (50% of your booking amount will be refunded)
8 weeks or less before embarkation: 100% cancellation fee will be charged (no refund)

IMPORTANT: For all rebooking's the T&C, the reservation policy and the cancellation policy for the initial reservation are valid. Once you have changed your reservation your initial cancellation options, dates and fees are still valid.

We always try to help and find a solution for our customers. As soon as you can see that you might cancel the booking please get in touch with us. We are happy to help and will find a solution.

VIII. Guaranteed Reservation Policy
The GETABOAT.MIAMI Local Partner is required to provide, within a given "guaranteed period" as defined below, the requested boat as confirmed at the time of booking, subject to the renter meeting rental requirements.

In the event the booked boat cannot be provided during this "guaranteed period", GETABOAT.MIAMI will contact you directly and provide you with the option to book alternative boats that are available. In the event of accident or boat damage prior to the "guaranteed period" an agreement will be reached with our local partner for a suitable replacement or reimbursement.

Flight / Train delay
If for any reason the renter is delayed for the booked date, it is the sole responsibility of the renter to inform GETABOAT.MIAMI and contact the local on-site partner (whom GETABOAT.MIAMI provide details)

IX. Failure to Collect 
Failure to collect your booked boat prior to closure of the local partner office without notification from the user of delay may result in the booking being cancelled with full charge. The local partner is at liberty to allow another booking to proceed the following day.

X. Failure to Return
Failure to return the vessel at the designated ‘check-in’ time will result in extra charges. These extra charges will be indicated and charged by the Local on-site partner. GETABOAT.MIAMI accepts no responsibility for renters who fail to return the boat at the specified check-in time.

XI. Force Majeure
Neither party shall be liable for failure in its performance hereunder caused by any case of Force Majeure. "Force Majeure" shall be considered - as defined by the applicable regulation(s) - as any irresistible or unforeseeable event, independent of the party suffering of the case of Force Majeure, which prevents this party from fulfilling its obligations.

Legal and/or medical documentation is required by the Renter in cases of "Force Majeure" and will be required by YACHTICO.com and the local partner for inspection prior to a ‘credit’ being issued to the renter. 

XII. Liability - Applicable Law – Competent Court
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations set out in this article may not apply. In particular, nothing in these terms and conditions will affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of GETABOAT.MIAMI. You expressly acknowledge and agree that GETABOAT.MIAMI, its officers, directors, employees will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to: damages for loss of profits, goodwill, use, data or other intangible losses (even if GETABOAT.MIAMI has been advised of the possibility of such damages), resulting from the online booking.

U.S. law and the law of the state of Florida is applicable if you have booked in U.S. Dollar.
